Photography & Video Usage Disclaimer
All photographs, videos, virtual staging images, and community/lifestyle photos (collectively referred to as “Visual Content”) created by SGS Solutions LLC DBA Luminary Fotos (“Company”) are governed by the following terms and conditions:
Ownership & Intellectual Property Rights
All Visual Content remains the sole property of SGS Solutions LLC DBA Luminary Fotos. The Company retains full copyright and intellectual property rights. Visual Content may not be resold, licensed, transferred, or distributed to any third party without the prior written consent of the Company.
Usage License
The purchasing agent, brokerage, or client is granted a limited, non-exclusive, non-transferable license to use the Visual Content exclusively for marketing and promoting the specific property depicted. This license begins upon delivery and remains valid until 30 days after the property is sold, rented, or taken off the market, whichever occurs first.
Restrictions on Use
The licensee is strictly prohibited from reselling, transferring, sublicensing, or sharing the Visual Content with any third party—including but not limited to other agents, brokerages, homeowners, or contractors—without the express written permission of SGS Solutions LLC DBA Luminary Fotos.
Company Rights
SGS Solutions LLC DBA Luminary Fotos reserves the right to reuse, resell, sublicense, or distribute any Visual Content at its discretion. The Visual Content is not exclusive to any client unless explicitly agreed to in writing.
Scope of Use
This license is limited to the specific property for which the content was created. Any use of the Visual Content outside of this context—whether for additional properties, extended campaigns, or post-listing use—requires written authorization and may be subject to additional licensing fees.
Editing & Modification
Minor modifications to the Visual Content are permitted if they serve the purpose of promoting the property (e.g., adding text, branding, or light editing). However, altering the content in a way that misrepresents the property, its features, or location is strictly prohibited.
Liability & Indemnity
The client agrees to hold SGS Solutions LLC DBA Luminary Fotos harmless and indemnify the Company from any claims, damages, or liabilities arising from improper or unauthorized use of the Visual Content.
Governing Law
This agreement is governed by the laws of the state in which SGS Solutions LLC DBA Luminary Fotos operates. Any disputes arising under these terms shall be resolved in accordance with the applicable jurisdiction.
Entire Agreement
This disclaimer represents the full agreement between SGS Solutions LLC DBA Luminary Fotos and the client regarding usage of the Visual Content. No changes or amendments shall be valid unless made in writing and signed by both parties.
By purchasing and using Visual Content from SGS Solutions LLC DBA Luminary Fotos, you confirm that you have read, understood, and agree to abide by the terms set forth in this disclaimer.
